NOTICE OF HEARING
VILLAGE OF SOUTH ELGIN
SOUTH ELGIN SPECIAL SERVICE AREA NUMBER 8 (BECKETTS LANDING SUBDIVISION)
NOTICE IS HEREBY GIVEN that on June 6, 2022, at 7 p.m. in South Elgin Village Hall, 10 N. Water Street, South Elgin, Illinois 60177, a hearing will be held by the President and Board of Trustees of the Village of South Elgin to consider forming South Elgin Special Service Area Number 8 (Becketts Landing Subdivision) (“Proposed SSA”) consisting of property located northwest of the intersection of McLean Boulevard and Stearns Road in South Elgin, Illinois, commonly known as Becketts Landing Subdivision, which territory is legally described as follows:
THAT PART OF THE SOUTHEAST QUARTER OF SECTION 33 AND OF THE SOUTHWEST QUARTER OF SECTION 34, TOWNSHIP 41 NORTH, RANGE 8 EAST OF THE THIRD PRINCIPAL MERIDIAN AND PART OF THE NORTHWEST QUARTER OF SECTION 3, TOWNSHIP 40 NORTH, RANGE 8 EAST OF THE THIRD PRINCIPAL MERIDIAN, DESCRIBED AS FOLLOWS:

(“Territory”) A map of the Proposed SSA is on file at the Office of the Village Clerk, 10 N. Water Street, South Elgin, Illinois 60177.
The purpose of forming the Proposed SSA is to provide special municipal services for the Territory, including funding for the operation, care, maintenance, and replacement of stormwater detention areas, retention areas, stormwater infrastructure, and landscaping located in and serving the Territory, including administrative costs (“Services”). The Village contemplates that it will serve as the Proposed SSA’s governing body and, as such, will receive and maintain the Special Service Area funds for use in providing or causing the provision of the Services as defined herein and in the ordinance establishing the SSA.
At the hearing, there will be considered the levy of an annual special tax sufficient to generate revenues needed for the Services, which revenues shall not exceed the “Maximum Rate.” For purposes herein, the Maximum Rate as of any given year the Proposed SSA is in existence shall not exceed an amount equal to $0.50 dollars per each $100 of equalized assessed value for each lot located in the Territory. This tax shall be levied for an indefinite period of time commencing during and in the years subsequent to the date of this Ordinance. The proposed tax amount for the initial year in which taxes will be levied in the SSA is 0%.
Notwithstanding the foregoing, taxes shall not be levied hereunder and the Proposed SSA shall be “dormant,” and shall take effect only after the Village Engineer, in his sole discretion, determines that the Services have not been properly or timely provided in accordance with all federal, state, and local ordinances, laws, rules, and regulations, as amended. Said tax shall be in addition to all other taxes provided by law, and shall be levied pursuant to the provisions of the Special Service Area Tax law (35 ILCS 200/27-5, et seq.).
At the hearing, all interested persons affected by the formation of the Proposed SSA, including all persons owning taxable real estate within the Territory, and the method of taxation proposed, will be given an opportunity to be heard. Parties unable to attend the hearing may submit comments before or after to the Office of the Village Clerk, 10 N. Water Street, South Elgin, Illinois 60177. The hearing may be adjourned by the Village Board to another date without further notice other than a motion to be entered upon the minutes of its meeting fixing the time and place of its adjournment.
If a petition signed by at least 51% of the electors residing within the Territory and by at least 51% of the owners of record of the land comprising the Territory is filed with the Village Clerk within 60 days following the final adjournment of the public hearing objecting to the creation of the Proposed SSA or the levy or imposition of a tax, no such special service area as proposed may be created, or tax may be levied or imposed, except as otherwise permitted by law.
